Employers must execute a Form I-9, Employment Eligibility Verification (Form I-9) on all employees.  The current version is required and a new version was released on Friday, Jan 31, 2020.  There do not appear to be any substantive changes to the form and the only things that appear to have changed are the version date (it is now 10/31/2019) and the expiration date (it is now October 31, 2022).

Employers who are using paper Form I-9s should discard any blank forms that have a version date (bottom, left-hand corner of pages 1, 2, and 3 of the Form I-9) other than “10/21/2019.”  Please note that using a prior version, from today until a new version is released, is an error that U.S. Immigration and Customs Enforcement will likely penalize if they conduct an audit.

Green and Spiegel’s Compliance and Regulatory Practice is ideally positioned to support employers in Form I-9 issues.  Please contact us if we can be of any assistance.
