Launch of DAPA and Expanded DACA Delayed

On February 17, 2015, a District Court Judge in Texas granted a temporary injunction, blocking implementation of the President’s executive orders to expand DACA and institute DAPA. USCIS is therefore not accepting applications for expanded DACA applicants, as had been previously planned.

The Department of Justice is appealing the injunction and it is possible that expanded DACA and DAPA will go into effect at a later date. As of now, however, the program has been temporarily halted. We do not yet know the timeline for the appeal decision.

We will be monitoring this situation carefully, and interested prospective beneficiaries of these programs can still be proactive. We encourage those that think they may be eligible for these programs to schedule a consultation to determine eligibility and plan next steps.

We are hopeful the Department of Justice is successful in their appeal and look forward assisting those foreign nationals who can benefit from these programs.
