Saskatchewan Sets New Rules For Recruiting and Hiring Foreign Workers

The newly implemented, The Foreign Worker Recruitment and Immigration Services Act, requires the licensing of recruiters and immigration consultants, as well as the registration of employers with the Saskatchewan government.

The deadline for recruiters and immigration consultants to submit a licensing application to the province is December 13, 2013. As of November 13, 2013, all employers are required to register with the provincial government. However, any employer who has recruited through the Saskatchewan Immigrant Nominee Program in the last two years is automatically registered with the province. Employment and Social Development Canada (ESDC)/Service Canada will verify all licensing of recruiters and consultants and registration of employers, as part of their assessment of Labour Market Opinion (LMO) applications.

As a result of these changes, the Third-party, Recruiter or Employment Agency Information section of the LMO application and Schedule A- Appointment of a Third-Party Representative form must be completed when submitting applications. For more information, please contact Green and Spiegel LLP.
